The meeting was called to order at 7:30 P.M. by Supervisor Paul T. Clark with 30 seconds of silent prayer followed by the Pledge of Allegiance.

    Town Attorney Tim Greenan advised that federal community development funds must be directed to projects that benefit low to moderate income persons and neighborhoods.

    Supervisor Clark explained that there were four components the Town of West Seneca received from the federal government, and every municipality in the country received block grant funds. The Town of West Seneca received these funds in proportion to its income and participated with the County Consortium of Communities whereby they shared expenses and expertise and utilized the county's staffing, which saved money on administering the funds. A little over 20 percent of the money goes into the housing fund and housing fund portfolio, which was separately maintained by part-time Community Development Director Geraldine Roach in connection with the county. A lot of the money was used to strengthen some of the lower and moderate income communities along the city line. The second component was for economic development, and this money was administered through the Erie County Economic Development staff. This was how the Local Development Corporation was funded and sometimes additional business projects were proposed to the Erie County Commissioner of Environment and Planning. The third component, about 27 percent of the block grant, was the community projects section, which was the purpose of this public hearing. This money went into a general pool and eligible projects were listed by all communities in the county. Under HUD guidelines, an eligible project could only be located in the city line area or certain census tract areas of the town where it was determined that there were low to moderately low income families. The projects included sidewalk repair, street reconstruction, curb repairs and driveway approaches. There were also some areas for either senior citizens or handicapped and disabled persons that would qualify under the HUD guidelines. After deciding on two or three projects, the town goes into a competition with other communities. Supervisor Clark noted that he was on the project selection committee with other mayors and supervisors, and they scored the projects based on how well they thought the project would help Western New York and if it was the best use of federal funds. The top graded projects would be funded up to a maximum of $90,000 per project, and West Seneca was very successful in the past.

    Marylou Dietrich, 156 Bellwood Avenue, questioned the status of a handicapped van for the senior citizens center. She further commented on the great need for a youth center in town and questioned the possibility of the Harlem Road and Indian Church Road area, suggesting that the old Tops Market be used.

    Supervisor Clark stated that the purchase of a handicapped van was approved by the board and they had advertised for bids. They were going to purchase the van off the state bid, but it was dropped off the list. Supervisor Clark thought that the purchase would be made within 45 days and paid for with prior housing money that was transferred earlier in the year. With regard to use of the old Tops Market on Harlem Road and Mineral Springs Road for a youth center, he understood that the building was going to be demolished.

    Mrs. Dietrich questioned why a basketball court was not put in the new park on Indian Church Road.

    Supervisor Clark responded that a public hearing was held and the residents of the area did not want a basketball court or any other athletic facilities.

    Councilman Graber noted that the residents felt that the park was located too close to the city. They thought city dwellers would be more likely to use it and would downgrade their park.

    Councilman Osmanski stated that the residents of that area did not want any sports fields. They only wanted green space with a walking path.

    Mrs. Dietrich felt that a girls and boys club was needed in town, especially in the Indian Church Road area.

    Supervisor Clark noted that financing was a problem and the maximum they could get from block grant funds was $90,000.

    Councilman Osmanski stated that the present Youth Center was underutilized and in bad shape, but the AmeriCorps would be holding an after school tutoring program there in the near future.

    Stanley Walek, 126 Electric Avenue, stated that there was no place for the children to play in the Clinton Street city line area and suggested that the board consider this area of town for use of the funds.

    Bob Rigby, 38 Cathedral Drive, asked the Town Board to consider a program that would assist first time homeowners with the cost of a home purchase for homes priced up to $75,000. The Towns of Cheektowaga, Hamburg, and Amherst and City of Lackawanna all had this type of program for low to moderate income persons. This would be considered a grant/loan up to an amount of $5,000 and set up at closing as a zero percent loan that would be forgiven if the homeowner resided in the home for five years or more. Mr. Rigby felt that this type of program would help alleviate absentee ownership in some areas of town and the problems it created. This would also allow the Building Inspector to inspect the home prior to closing to ensure that the building codes were complied with.

    Councilman Osmanski noted that this type of program was already in existence in West Seneca.

    Supervisor Clark stated that the program was available until the money ran out, and he suggested that Mr. Rigby check with Community Development Director Geraldine Roach for the appropriate contact person in Erie County.

    Mr. Rigby stated that he was very active in the real estate community and was unaware that West Seneca had this program. He suggested that there be better advertising of the program.

    Supervisor Clark stated that the suggestions made at this meeting were either ineligible or involved too much money for the competition portion which was a $90,000 limit. Three projects that he suggested for the money were: 1) Sidewalks on Thorndale Avenue; 2) Handicapped lavatory facilities at the West Seneca Library; 3) Computer lab for senior citizens. Supervisor Clark stated that the sidewalks on Thorndale Avenue were very bad and this project would help the goals of HUD which were to strengthen areas of housing that were considered somewhat at risk. This would be about a $250,000 project so the town would have to bond $160,000 if they received the maximum of $90,000. The West Seneca Library was built in the 1960's, and although it was a beautiful building, Supervisor Clark noted

    that there were no handicapped restroom facilities in it. This project would cost about $30,000 and the town would match it with 50 percent. Supervisor Clark further stated that senior citizens had expressed an interest in learning more about computers and e-mail. They already had some borrowed equipment from banks and offices, but they were not all compatible and could not be networked. This project would cost approximately $33,237 and he understood that the Senior Citizens Association would agree to contribute toward a 50 percent match with the town.

    Councilman Osmanski noted that the county controlled a pool of funds for youth services and economic development, but they were separate from the block grant funds. They could pursue other avenues for the Casimer Street area. With regard to the Thorndale Avenue area, Councilman Osmanski commented that it was a good strong neighborhood and they wanted it to stay that way. They wanted to keep good home ownership in these neighborhoods and continuing to invest in them was important. Many of the streets were fully reconstructed and landscaped to make them livable communities. He felt that this was a good investment for everyone in town because as assessments are raised in that area of town, the people in other areas benefit by not having to make up for the tax dollars.

    Mrs. Dietrich commented on the computer lab for the senior citizens and suggested that computers also be bought for the tutoring program at the youth center since their cost was now so reasonable.

    Councilman Graber stated that children were learning about computers in school, but the seniors had no access to them. The senior citizens computer lab would provide them with minimum access. Councilman Graber further noted that Youth Director Mark Lazzara had a separate funding source where he could provide this type of technology for the tutoring program.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to close the public hearing.

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize Supervisor Clark to sign, submit and execute a contract with Erie County Community Development Block Grant Consortium for $90,000 to replace sidewalks and approaches on the entire length of Thorndale Avenue, noting that the completed project will create safe, hazard-free walking conditions on Thorndale Avenue where none presenting exist and the Town of West Seneca will contribute $160,000 in matching funds or 64 percent of the total project cost of $250,000.

    Motion by Supervisor Clark, seconded by Councilman Hicks, to authorize Supervisor Clark to sign, submit and execute a contract with Erie County Community Development Block Grant Consortium for $15,000 for the installation of handicapped accessible doorways and a handicapped accessible lavatory at the West Seneca Public Library, noting that the completed project will allow the town to comply with the Americans With Disabilities Act as it relates to municipal buildings and the Town of West Seneca will contribute $15,000 in matching funds or 50 percent of the total project cost of $30,000.

    Motion by Supervisor Clark, seconded by Councilman Hicks, to authorize Supervisor Clark to sign, submit and execute a contract with Erie County Community Development Block Grant Consortium for $16,610 for a computer lab at the West Seneca Senior Citizens Center, noting that the Town of West Seneca and/or the Senior Citizens Association will contribute $16,627 in matching funds or approximately 50 percent of the total project cost of $33,237.

    Supervisor Clark abstained from this vote due to the fact that the developer was a client of an accounting firm that he had a financial interest in.

    4.   Town Attorney re Final written scope for SGEIS at North America Center

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to adopt the attached resolution with regard to the final written scope for the Supplement Generic Environmental Impact Statement for high technology and target manufacturing and service industry development at North America Center.

    On the question, Supervisor Clark stated that the Town of West Seneca had been trying to attract very clean, high technology, industry for the industrial park, and they had received funding for a possible chip fab manufacturer. They were also looking at other high tech industries, and the scoping document would approve some of the traffic studies and original land use concepts that were the same as when the original environmental impact statement was filed. The scoping document would give the town more strength in offering a shovel-ready site to a company who might want to locate there.

    On the question, Councilman Wroblewski noted that there was a possibility this expense would be reimbursed by Essex Insurance, the insurance company for the restaurant.

    PROBLEMS OF THE PUBLIC

    REQUEST FOR SUPPORT FOR TAX EXEMPTION BILL #6265-A

    Dorothy Meyer, an American Gold Star Parent, spoke on behalf of South Buffalo Chapter 26 and explained that an American Gold Star Parent was someone who had lost a son or daughter in active military service. Mrs. Meyer asked for local support for Tax Exemption Bill #6265-A for Gold Star Parents. The bill was passed on August 23, 2000 by Governor Pataki, but each individual local district had to decide the percentages that would be allowed to the parents. There was also Annuity Bill #4709 that was presently before the NYS Legislature, and Massachusetts had passed the bill three years ago.

    Supervisor Clark stated that he respected and appreciated the sacrifice that Mrs. Meyer and other families underwent through their loved ones' service to the country, and he wanted to pursue these bills. He had started researching the bills and understood that this would be similar to the veteran's exemption, but he wanted to do some fact finding first and get some indication as to what the impact would be from a tax base point of view. Supervisor Clark noted that they had until May 1, 2001 to respond to this measure and stated that he would look for every opportunity to support it. They would be probably be calling for a public hearing prior to the deadline and would contact Mrs. Meyer and other chapter members to attend.

    Mrs. Meyer understood that the bills would have to be approved by the town prior to January 1, 2001 in order to be effective for the new year.

    Supervisor Clark stated that Joseph Maciejewski, Director of the Erie County Real Property Tax Department, informed him that the exemption must occur prior to May 1, 2000 and it would be applicable the next year. The Town Board must also schedule a public hearing. The County of Erie would be separate from the town, but he understood that they were also considering this for county tax exemption. Supervisor Clark stated that he would do some more research and contact Mrs. Meyer when the public hearing was scheduled.

    Mrs. Meyer presented Supervisor Clark with a copy of the bills.
