WHAT YOUR TOWN COURT IS AND DOES

The Town Court plays a vital role in the protection of our safety and our rights as residents of the Town of West Seneca.   Every town, city and village has a Court which handles civil and criminal matters.

Any criminal act which occurs in this town is initially under the jurisdiction of our Town Court.   After the arrest occurs, the individual is brought to court for an arraignment.  The arraignment is the time when a plea of guilty or not guilty is entered to the charge, and if necessary, bail is set.  Bail is an amount of money which an arrestee has to pay if he wishes to be released from jail, pending disposition of the criminal matter.

West Seneca Town Court meets every Tuesday and Friday evening to hear criminal and civil matters.   Trials and arraignments are held on other days of the week as they are needed.

When a defendant appears on a Tuesday or Friday, they will appear with his or her attorney.   By that date, a background check will have been conducted by the Erie County District Attorney's Office who will then attempt to resolve any discrepencies in the case and negotiate a plea or set the matter for trial.   The District Attorney's Office has an assistant in each of the individual Town Courts to handle these criminal matters.   On the Court date, any victims and the arresting officers will also appear to discuss the case with the Assistant District Attorney.

The Town Court will also resolve civil disputes up to $3,000 in value.  Any individual who resides or does business in this Town may bring an action in our Town Court, against any other individual living in Erie County.   An individual not residing in this Town may also sue, in our Town Court, any individual residing or doing business in the Town of West Seneca.

The court will also hear matters concerning landlords and tenants such as eviction proceedings, rent due or abandonment of the property.  Any violations of the West Seneca Town Code, such as zoning, the noise ordinance, property maintenance, etc. and violations of the New York State Vehicle and Traffic Code will also be heard in the court.  These matters are scheduled for Friday afternoons.

Our Town Court also handles Small Claims Court actions.  These matters are heard on the first Wednesday of each month and depending on various circumstances, some may be heard on a Tuesday or Friday.  Only an individual may bring an action in Small Claims Court up to a monetary limit of $ 3,000.00 against any person or corporation who owes money if that person or corporation (1) lives, (2) has an office for the transaction of business or (3) works within the Town.

All criminal, civil and Small Claims Court proceedings are open to the public.  If you are interested in learning more about our court, please feel free to observe the proceedings.   The Court is in session for criminal and civil matters on Tuesday at 7:00PM and Friday evenings beginning at 6:30 PM.  Small claims court matters are scheduled for the first Wednesday of each month beginning at 7 o'clock.  Town Code and traffic violations are heard on Friday afternoons at 4:00 P.M.
