West Seneca Planning Board Meeting Minutes 12/10/2009
Chairman Robert Niederpruem called the meeting to order at 7:00 P.M. followed by the Pledge to the Flag. ROLL CALL: Present -
Joseph Ciancio Gerald Greenan Donald Mendola Jim Rathmann Anthony Nigro Joseph Sherman Robert Pinnavaia, Asst Code Enforcement Officer Jeffrey Harrington, Deputy Town Attorney Absent - None Chairman Robert Niederpruem read the Fire Prevention Code instructing the public where to exit in case of a fire or other emergency. APPROVAL OF PROOFS OF PUBLICATION Motion by Greenan, seconded by Rathmann, to approve the proofs of publication and posting of legal notice.
APPROVAL OF MINUTES Motion by Greenan, seconded by Rathmann, to approve Minutes #2009-10 of November 12, 2009.
NEW BUSINESS COMMUNICATIONS SPR2009-09
Motion by Greenan, seconded by Mendola, to issue a negative declaration, noting that the project will not have an adverse effect on the environment.
Motion by Greenan, seconded by Mendola, to approve the above request, conditioned on petitioner obtaining an area variance for parking from the Zoning Board of Appeals; and further that petitioner provide greenery along the west side of the building.
2009-17 Jay A. Pohlman, Esq., attorney, and Rick Flett, property owner, appeared on the request. Issues were discussed, including the fence on the north property line and parking and drainage issues. A number of residents had concerns about the drainage at the rear of the property. Ed Zurek, 2268 Transit Road complained of kids entering his yard and if there was to be a barrier, it would need to be a fence. Motion by Mendola, seconded by Ciancio, to table this item pending submission of survey and site plan of business and proposed 100 x 300 ft parcel and investigation of drainage problems and overall parking on the site.
2009-B Motion by Greenan, seconded by Nigro, to grant preliminary plat approval, with stub road with second outlet on Camelot, submission of tree survey and provision for a conservation area by way of deed restriction.
SPR2009-10 Motion by Greenan, seconded by Rathmann to approve the above request.
OTHER BUSINESS: A request from St. John’s Lutheran Church for informal discussion on a proposed new church building. Chairman Niederpruem noted the absence of representative from St. John’s Lutheran Church. ADJOURNMENT: Motion by Greenan, seconded by Nigro, to close the public hearing and adjourn the meeting (9:30 pm).
