Supervisor Paul T. Clark called the meeting to order at 7:30 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Clark read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.

The meeting was dedicated to the memory of James F. Brady, Mary Jane Brady, Paul T. Stadler, Dorothy Baich, Irene Schwanekamp, and Ruth J. Timmel.

    14-B    COMMUNICATIONS.

    1.   Supervisor Clark re Retirement of Harold Carberry as part-time laborer.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to accept the retirement of Harold Carberry and terminate him as part-time Laborer effective October 12, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that Mr. Carberry had 15 years of service with the town.

    2.    Supervisor Clark re West Seneca Chamber of Commerce 5K Scholarship Walk & Run.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to grant permission for the West Seneca Chamber of Commerce to hold their 14th annual 5K Scholarship Walk & Run on Saturday, September 28, 2002 with the walk starting at 10:00 A.M. and the run starting at 11:00 A.M. on designated streets in the Town of West Seneca.

    3.   Supervisor Clark re West Seneca West Senior High School Homecoming Parade.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to grant permission for West Seneca West Senior High School to hold their Homecoming Day parade on Friday, October 11, 2002 from 5:30 P.M. to 6:00 P.M. on designated streets in the Town of West Seneca.

    4.   Supervisor Clark re Halloween Parade.

    Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize Southgate Plaza to host the annual Halloween Parade for the Town of West Seneca on Sunday, October 20, 2002 with assembly behind the West Seneca Town Hall at 11:15 A.M. and the parade starting at noon.

    5.   Supervisor Clark re Designation of Halloween.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to designate Thursday, October 31, 2002 from 6:00 P.M. until 8:00 P.M. as the official night for trick or treat, noting that residents are asked to leave their porch lights on to provide lighting and safety for the children and drivers should use extra caution.

    6.   Town Attorney re West Seneca Youth Hockey Association agreement.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the Supervisor to execute the proposed agreement with West Seneca Youth Hockey Association covering the 2002 - 2003 season with fees as follows:

    Midgets    -    $56 per game       Bantams   -   $44 per game
    Peewee     -   $38 per game Squirt      -    $32 per game
    Mites         -   $30 per game

    7.   Town Attorney re Public hearing on use of Federal Community Development Funds.

    Motion by Councilman Osmanski, seconded by Councilman Graber, to schedule a public hearing for Monday, October 14, 2002 at 7:30 P.M. to provide an opportunity for citizens to express community development and housing needs and to discuss possible projects that would benefit low and moderate income persons in the Town of West Seneca.

    8.   Town Attorney re Final Supplemental Generic Environmental Impact Statement for North America Center.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to adopt the attached resolution issuing a Notice of Completion of the Final Supplemental Generic Environmental Impact Statement for North America Center Industrial Park for High-Technology, Manufacturing and Service Industry Development.

    On the question, Supervisor Clark stated that adoption of this resolution would allow high tech development to occur within the industrial park. The town was trying to attract a large low impact user that would create jobs and additional economic impact in Western New York, and they were marketing the industrial park worldwide as a potential high tech use location.

    9.   Town Attorney re Cooperation Agreement for County Housing & Community Development Consortium.

    Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize the Supervisor to execute the three-year Cooperation Agreement between the town and county regarding the town's participation in the County Housing and Community Development Consortium.

    On the question, Supervisor Clark stated that a number of years ago the town agreed to work with the county in joining a group of communities who would pool the federal housing and urban development (HUD) money that was allocated to them each year. There were three main components of the money - economic development, housing, and specialized projects in which they competed with other towns for the money. A lot of expertise was required to handle and administer the money in accordance with the regulations of HUD, and this would renew the town's agreement with the county for three years.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize payment of $2600 to MVR Service, Inc. for repairs to high-pressure pump.

    11.   Chief Gehen re Permanent appointment of Dale Wight as Asst. Chief of Police.

    Motion by Councilman Osmanski, unanimous second, to terminate Dale Wight as Provisional Assistant Chief of Police effective September 23, 2002 and appoint Dale Wight as Assistant Chief of Police effective September 24, 2002 at an annual salary of $71,946 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    12.   Chief Gehen re Appointment of Robert Andolina as Detective Temporary .

    Motion by Councilman Osmanski, seconded by Councilman Graber, to grant a leave of absence to Robert Andolina from his position as Police Officer effective September 23, 2002 and appoint Robert Andolina as Detective Temporary effective September 24, 2002 at an annual salary of $56,637 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    13.   Chief Gehen re Attendance at International Association of Chief's of Police conference.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize Chief Gehen to attend the 109th annual International Association of Chief's of Police Conference in Minneapolis, Minnesota, October 5 - 10, 2002 at a cost not to exceed $1850.

    14.   Chief Gehen re Bid date for unmarked police vehicle.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to set a bid date of October 16, 2002 for receipt of bids on the purchase of one (1) unmarked police vehicle.

    15.   Recreation Director re Appointment of Erin Czarnecki as part-time Lifeguard.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to appoint Erin Czarnecki as part-time Lifeguard, Step 1, to work with the West Seneca Competitive Swim Team "The Sharks" effective September 24, 2002 through May 31, 2003 at a rate of $5.95 per hour and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    16.   Recreation Director re Rate increase for Jody Pangburn.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to grant a rate increase to $6.20 per hour to Jody Pangburn effective June 29, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that Ms. Pangburn worked the 400 hours necessary for this increase.

    17.   Senior Citizens Supervisor re Status change for June Edie to part-time seasonal.

    Motion by Councilman Osmanski, seconded by Councilman Graber, to change the status of Food Service Helper June Edie from part-time to part-time seasonal effective September 23, 2002 through February 20, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    18.   Senior Citizens Supervisor re Appointment of Jeanette Kropczynski as part-time Clerk Typist.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to appoint Jeanette Kropczynski as part-time Clerk Typist at a rate of $6.90 per hour effective September 24, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    19.   Youth Director re Attendance at AmeriCorps member exchange program.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize Youth Director Mark Lazzara, two AmeriCorps supervisors, and six AmeriCorps members to travel to Montana and Yellowstone National Park to participate in a Corps exchange program with the Montana Conservation Corps October 10 - 13, 2002 at a cost not to exceed $4940.00, which includes gas, food, lodging, and airfare.

    PROBLEMS OF THE PUBLIC

    RECONSTRUCTION OF BELMONT DRIVE

    Cindy Atzrott, 9 Belmont Drive, understood that curbs and sidewalks were to be installed on her street along with Woodward Drive and Hybank Drive. She questioned if this work would definitely be done and noted that she and some of her neighbors were opposed to it. They did not want their taxes to be increased and did not want to have to shovel sidewalks in the winter. They also felt that the nature of the neighborhood would be changed with the removal of mature trees for the sidewalks.

    Principal Engineering Assistant Gary Bommer stated that the project involved a total road reconstruction, including sidewalks and curbs, new sub-base and pavement for the road, and drainage with lines to every home.

    Mrs. Atzrott questioned if the curbs and sidewalks were required if the residents of the streets did not want them.

    Mr. Bommer stated that it was the town's policy in recent years to install sidewalks and curbs with a total road reconstruction.

    RECONSTRUCTION OF BELMONT DRIVE    (continued)

    Councilman Osmanski stated that the residents were not yet notified because the project was only in the preliminary stages. The Engineering Department was directed to do the surveying, but before the project proceeded any further, the residents would be notified. Councilman Osmanski stated that when sidewalks were installed they tried to avoid as many trees as possible, but many of the residents would ask that certain trees be taken down. Safety concerns brought about their decision to install sidewalks on road reconstruction projects, because they did not want children to have to walk in the street. The curbing was also for safety reasons as well as for aesthetics.

    Mrs. Atzrott questioned if sidewalks would have to be installed on both sides of the street and if the residents' taxes would go up as a result.

    Mr. Bommer stated that it was typical for sidewalks to be installed on both sides of the street.

    Councilman Osmanski stated that the sidewalks would be assessed on the town as a whole, not against each individual property owner on the street. He further commented that in a new subdivision it would be unheard of to not install sidewalks and curbing.

    Mrs. Atzrott responded that she moved to Belmont Drive because of the nature of the street with no curbs or sidewalks.

    Supervisor Clark stated that if there were an overwhelming number of residents of the street that did not want the sidewalks and curbing, the Town Board would discuss it and try to find a way to keep everyone happy. He thought that generally the residents wanted sidewalks and curbs and suggested that Mrs. Atzrott and her neighbors seriously consider whether or not they wanted them.

    Councilman Osmanski stated that the Engineering Department would go door-to-door and explain to the residents what was happening and what impact there would be on the residents.

    Mr. Bommer stated that when the surveying was finished and they had a preliminary design, they would notify all the residents.

    Councilman Graber suggested using the country curbing that served as a sidewalk and a curb.

    Mr. Bommer responded that they had not been using country curbing because the curb and gutter type kept the traffic on the road and allowed for parking along the curb without parking on the grass.

    Supervisor Clark stated that over the last several years the Town of West Seneca was on a very ambitious program to rebuild any deteriorating road conditions. The money was taken from General Highway Funds, which was townwide. The entire town paid for general upgrades and improvements and maintenance that involved any major construction of town highways. There were also county and state highways and bridges that were reconstructed with county and state money and none of it was specifically added on like a footage charge to a residence.

    PAYMENT TO SYNCHRONET FOR COMPUTER SERVICES

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize payment of $1741 to Synchronet Industries, Inc., 2430 North America Drive, West Seneca, NY 14224, for services performed on the Police Department computer system, which included software and hard drives that were installed and corrected.

    STATUS OF ZONING VIOLATIONS AT LIBERTY MOTORS

    Councilman Osmanski questioned the status of the zoning violations at Liberty Motors on Clinton Street.

    Building Inspector Bill Czuprynski stated that a summons was being issued each week and the case would be in court on Friday, September 27, 2002.

    BILLBOARD LIGHTING ALONG ROUTE 400

    Councilman Osmanski questioned if the Building Department was monitoring the lighting of billboards along Route 400, noting that the lights should be off at 11:00 P.M.

    Building Inspector Bill Czuprynski stated that his department would periodically check on the lights over the next few weeks.

    BID DATE FOR ICE RINK ROOF REPLACEMENT

    Motion by Councilman Hicks, seconded by Councilman Graber, to set a bid date for October 7, 2002 at 10:00 A.M. for receipt of bids on roof replacement at the Ice Rink.

    BID DATE FOR POOL REPAIRS

    Motion by Councilman Hicks, seconded by Councilman Graber, to set a bid date for October 7, 2002 at 10:00 A.M. for receipt of bids on re-plastering the pool, pump replacement, and other necessary repairs.

    On the question, Councilman Osmanski suggested that the bid include an option of an estimate on what it would cost to heat the pool.

    DISPOSAL OF SANIVAN

    Motion by Councilman Hicks, seconded by Supervisor Clark, to authorize disposal of sanivan #104 at Alden Truck Company at a cost of $250.00, noting that only the cab and chassis remained and were beyond repair.

    RELEASE OF DRAINAGE EASEMENT ON SUNSET CREEK DRIVE

    Town Attorney Tim Greenan stated that the resident at 60 Sunset Creek Drive (Lot No. 14) had an issue with a rear yard drainage easement that showed up on the Map Cover but was not necessary to service the property. This issue was particular only to the one lot, and Mr. Greenan suggested that the Town Board release any interest the town had in the rear yard drainage easement.
