1.   Supervisor Clark re Resolution in support of federal funds for Bethlehem retirees health care benefits

Motion by Councilman Osmanski, unanimous second, to adopt the attached resolution in support of establishing a federal fund dedicated to providing health care benefits and prescription drug coverage for steelworker retirees and their beneficiaries who lose their coverage as a result of bankruptcy proceedings, sale of corporate assets, unfair trade practices, or foreign competition.

On the question, Supervisor Clark stated that unfair trade practices internationally had affected the steel industry and caused the removal of benefits from individuals that spent their lives and careers earning the benefits. The widespread termination of 95,000 workers nationwide was devastating, and the Town of West Seneca had several hundred retirees of Bethlehem Steel. Although the town could not take any direct action, Supervisor Clark wanted their voice to be heard on behalf of the residents.

2.   Supervisor Clark re Kiwanis Arts & Crafts Festival

Motion by Councilman Osmanski, seconded by Councilman Hicks, to grant permission for the Kiwanis Club of West Seneca to reserve Friday, July 11, 2003 (for set up) and Saturday & Sunday, July 12 - 13, 2003 from 6:00 A.M. until 6:00 P.M. each day for the annual Arts & Crafts Festival on Town Hall grounds, including the grass area in front of Town Hall and the Library from Main Street to Legion Drive, the grass area outside the baseball diamond fence in front of the Lions Bandshell, the parking facilities behind the Town Hall and in front of the Ice Rink, and the ice rink facilities.

3.   Town Engineer re Sunnyside Drive Drainage Project, final change order and acceptance

Motion by Councilman Osmanski, seconded by Supervisor Clark, to approve final change order #1 for Buffalo Creek Inc., 11800 Route 20A, Wales Center, NY 14169, for a net addition of $4925.30 and accept the Sunnyside Drive Drainage Project, Job No. S-0104, at a final contract amount of $41,175.30.

4.   Town Engineer re Federal Stormwater Regulations - Submission of NYSDEC Notice of Intent form

Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize the Supervisor to sign the attached NYSDEC Notice of Intent form indicating that the town requests to be authorized by DEC's general SPDES permit for storm water discharges from a small municipal separate storm sewer system (MS4) in New York State and agrees to comply with all applicable terms and conditions of the small MS4 general permit.

5.   Town Engineer re Purchases requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize payment of $4500 to Siewert Equipment Co., Inc. for repairs to a portable pump and $6980 to Buffalo Tractor & Implement Co., Inc. for installation of a Ford power unit in a Gorman Rupp sewer pump.

6.   Chief Gehen re Bid award for purchase of mobile data terminals

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to award the bid for the purchase of eight (8) Panasonic Toughbook model 28 laptop computers with backlit keyboards to TDN Government Sales Division, 1000 Young Street, Tonawanda, New York, at their bid price of $32,192.00, noting that 75 percent of this purchase ($24,144) will be covered by the 2002 COPS MORE grant #2002CMWX0055 and the remaining 25 percent ($8048) will be covered by the 2002 police equipment bond.

On the question, Supervisor Clark stated that although only one bid was received the price was lower than the current NYS contract pricing.

7.   Chief Gehen re Military leave of absence for Officer James Gibbons

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to grant a military leave of absence for Police Officer James Gibbons effective March 2, 2003 through March 1, 2004 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

8.   Chief Gehen re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize payment of $3517.80 to North Eastern Uniforms for police uniforms.

9.   Town Clerk re Attendance at NYS Town Clerk's Association conference

Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize Town Clerk Patricia Wisniewski to attend the New York State Town Clerk's Association annual conference in Buffalo, New York, April 27 - 30, 2003 at a cost not to exceed $800.

10.   Comptroller re 2002 year end fund transfers

Motion by Councilman Osmanski, seconded by Supervisor Clark, to approve the attached list of year-end fund transfers for 2002.

11.   Recreation Director re Bid date for arts & crafts supplies

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to set a bid date of March 18, 2003 at 10:00 A.M. for receipt of bids on arts and crafts supplies necessary to conduct the 2003 town recreation program.

12.   Recreation Director re Rate increase for part-time employees

Motion by Councilman Osmanski, seconded by Supervisor Clark, to grant a rate increase to the following Recreation Department employees who worked the required 400 hours of service:

and further, grant a rate increase to $7.40/hr. for Kathleen Pacella effective July 21, 2002, noting that Ms. Pacella completed the necessary 1400 hours of service, and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

13.   Senior Citizens Supervisor re Appointment of James Pjontek as part-time Van Driver

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint James Pjontek as part-time Van Driver effective February 24, 2003 at a rate of $7.40 per hour, noting that Mr. Pjontek would be replacing Jim Bleeze who was retiring as a part-time Van Driver effective February 26, 2003, and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

14.   Youth Director re Status change for Diane Kilijanski to part-time seasonal

Motion by Councilman Osmanski, seconded by Councilman Hicks, to change the status of Diane Kilijanski from part-time to part-time seasonal effective March 3 - May 30, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

15.   Youth Director re Contract with NYSDEC for conservation services at Reinstein Woods Nature Preserve

Motion by Councilman Osmanski, seconded by Supervisor Clark, to approve the attached contract #C004496 between the NYS Department of Environmental Conservation and the West Seneca Youth Bureau/AmeriCorps on behalf of the Service Action Corps, noting that the contract will allow the West Seneca Service Action Corps to provide conservation services at Reinstein Woods Nature Preserve and the terms will be October 1, 2002 to September 30, 2005.

On the question, Councilman Osmanski questioned whether Town Attorney Tim Greenan had reviewed the contract.

Mr. Greenan responded that he briefly reviewed the contract prior to the meeting, and it appeared to him that this was a form DEC contract with the scope of services and reimbursement outlined in the attached schedules. The state requirements contained in the long text at the end of the contract were typical of what would be in any state contract with regard to affirmative action, etc.

PROBLEMS OF THE PUBLIC

RESIDENT REQUESTS SUPPORT FOR VERIZON WORKERS

James Wagner, 67 Cloverside Court, stated that he was employed by Verizon Communications for 25 years and was the area Vice President for Local 1122, Communications Workers of America. He asked the Town Board to reconsider utilizing Choice One as the local phone service provider for the town and use Verizon instead. Mr. Wagner informed the board members that it was Verizon's plant that was in use and Verizon employees that built and maintained the network. Verizon endured a layoff of 125 members in Western New York and these were good paying, high quality, good benefit jobs. These members lived and worked in the community and volunteered their time and service for the betterment of the community. Mr. Wagner noted that Choice One had a skeleton workforce that was non-union and none of the employees lived in Western New York or paid taxes to the community.

Councilman Graber responded that the Town of West Seneca did not use Choice One, they used Adelphia Business Solutions.

RESIDENT REQUESTS SUPPORT FOR VERIZON WORKERS    (continued)

Mr. Wagner stated that he had been misinformed, but still requested that the board members reconsider and utilize Verizon instead of Adelphia. There were a number of Verizon employees that owned homes and paid taxes in West Seneca and had endured the layoff. Verizon was threatening additional layoffs and he was concerned about the continual loss of these good paying jobs. Mr. Wagner asked that the board members take a stand and support the workers at Verizon.

Councilman Osmanski stated that he wanted to find out more information before taking any action on this matter.

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

TITLE CHANGE FOR M. LEONE FROM FULL-TIME CLERK TYPIST TO PART-TIME

Motion by Councilman Osmanski, seconded by Councilman Hicks, to terminate Michele Leone as full-time Clerk Typist Temporary effective February 24, 2003 and appoint Michele Leone as part-time seasonal Clerk Typist effective February 24, 2003 at a rate of $10 per hour with the seasonal status ending on May 24, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

PATRICIA WISNIEWSKI - ERIE COUNTY TOWN CLERK OF THE YEAR

Councilman Wroblewski congratulated Town Clerk Patricia Wisniewski on being chosen Erie County Town Clerk of the Year 2003 by the Erie County Town Clerk's Association.

WEST SENECA YOUTH BUREAU/AMERICORPS RECEIVES NATIONAL AWARD

Supervisor Clark had received acknowledgement of a national award that was issued in Washington D.C. called the Excellence in Corps Operations award. The Excellence in Corps Operations committee on behalf of the National Association of Service and Conservation Corps recognized the West Seneca Youth Bureau/AmeriCorps as an NASCC ECO 2002 Corps. Supervisor Clark further stated that he had attended the AmeriCorps graduation ceremonies at the Red Cross mansion on Delaware Avenue last week and it was gratifying to see so many fine people, young and old, receive their service award.

LOCAL COOPERATION AGREEMENT FOR CAZENOVIA CREEK ICE CONTROL PROJECT

Town Attorney Tim Greenan stated that the final version of the local cooperation agreement between the town and the NYS Department of Environmental Conservation with regard to the Cazenovia Creek ice control project was completed. The agreement had been delivered to his office for signing, and he requested that the Town Board authorize Supervisor Clark to execute the agreement.

Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize Supervisor Paul T. Clark to execute the local cooperation agreement between the Town of West Seneca and the NYS Department of Environmental Conservation for construction of the Cazenovia Creek ice control project.

On the question, Councilman Osmanski thanked Mr. Greenan and Town Engineer George Montz for their work in moving this project forward.
