Supervisor Paul T. Clark called the meeting to order at 7:30 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Clark read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.

The meeting was dedicated to the memory of Mary Klubek, Robert Falkner, Irma Eckley and Albert J. Adrian.

Supervisor Clark presented Town Clerk Patricia Wisniewski with a Certificate of Recognition from General Code for her outstanding and dedicated service to the Town of West Seneca. Cheektowaga Town Clerk Mary Holtz nominated Mrs. Wisniewski as a Municipal Clerks Honor Roll 2003 Honoree.

    1.   Town Engineer re Bid award for Chamberlin Drive Revitalization Project

    Motion by Councilman Osmanski, seconded by Councilman Graber, to award the Chamberlin Drive Revitalization Project, Job No. C-0303, to Occhino Corporation, 2650 Seneca Street, West Seneca, NY 14224, at their low unit item contract amount of $188,701 and authorize the Supervisor to sign the contract documents.

    Supervisor Clark abstained from voting on this motion because Occhino Corporation was a client of an accounting firm that he had a financial interest in.

    2.   Town Engineer re Bid date for Union Road Lift Station Replacement Project

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to set a bid date of June 16, 2003 at 10:00 A.M. for receipt of bids on the Union Road Lift Station Replacement Project, Job No. U-0305.

    3.   Town Engineer re Norwood Drive Reconstruction, Change Order No. 1

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to approve Change Order No. 1 in the amount of $33,938.66 for Master's Edge, Inc., 1807 Elmwood Avenue, Suite 290, Buffalo, NY 14207 for performing extra work on the Norwood Drive Reconstruction Project.

    On the question, Councilman Osmanski commented that $33,938.66 was a large Change Order, but the project itself was very large at almost $700,000. He asked for a summary from Town Engineer George Montz as to what was included in the Change Order.

    Mr. Montz advised that this Change Order consisted of 17 various items including addition of a storm sewer manhole, installation of 12-inch ductal iron pipe in lieu of HDPE due to a grade problem, tree removals, sanitary sewer and watermain relocations, etc. He noted that these were all normal types of items that they came across in this type of project.

    4.   Town Engineer re Purchase requiring Town Board approval

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize payment of $1900 to URS Corporation for centerline stakeout of Leydecker Road from East & West Road north to the bridge over Cazenovia Creek.

    5.   Highway Supt. re Retirement of Gerald Klinck as Laborer in Bldgs. & Grounds Dept.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to accept the retirement of Gerald Klinck and terminate him as Laborer effective May 31, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    6.   Highway Supt. re Permanent appointment of Robert Hauger as Laborer in Bldgs. & Grounds Dept.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to terminate Robert Hauger as Temporary Laborer and appoint Robert Hauger as Laborer in the Buildings & Grounds Department effective June 1, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    10.   Chief Gehen re Application to US Dept. of Justice for enhancement of local domestic preparedness activities

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize Supervisor Paul T. Clark of the Town of West Seneca to submit an application to the U.S. Department of Justice, Office of Community Orientated Policing Services, Homeland Security Overtime Program, requesting $49,998 that will enhance local domestic preparedness activities by providing additional overtime funding for the West Seneca Police Department, noting that the town agrees to match grant funds up to $16,666 or 25 percent of the amount requested in cash.

    11.   Chief Gehen re Application to US Dept. of Justice for School Resource Officer

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize Supervisor Paul T. Clark of the Town of West Seneca to submit an application to the U.S. Department of Justice, Office of Community Oriented Policing Services, COPS in Schools Program, requesting $125,000 over three years that will enable the West Seneca Police Department to hire one sworn officer who will be assigned to the West Seneca Central School District as a School Resource Officer, noting that the Town of West Seneca agrees to match grant funds with $66,949 in cash over three years and to retain the officer one year after the award period.

    On the question, Supervisor Clark thanked Chief Gehen for working with the school district and pursuing grant funding for a School Resource Officer. The pilot program that was in effect for quite some time was working very well and receipt of this grant would allow for more police presence in the schools.

    12.   Chief Gehen re Termination of leave of absence for Philip Steffan and appointment as Patrol Lieutenant

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to terminate the leave of absence for Philip Steffan, Lieutenant of Detectives Temporary, effective October 26, 2002 and appoint Philip Steffan as Patrol Lieutenant effective October 27, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    13.   Chief Gehen re Leave of absence for John Urbanski and appointment as Lieutenant of Detectives Temporary

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to grant a leave of absence to John D. Urbanski as Patrol Lieutenant effective October 26, 2002 and appoint John D. Urbanski as Lieutenant of Detectives Temporary effective October 27, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    14.   Town Clerk re Attendance at New York Association of Local Government Records Officers annual school

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize Town Clerk Patricia Wisniewski to attend the New York Association of Local Government Records Officers annual school in Corning, New York, June 1 - 4, 2003 at a cost not to exceed $650.00, noting that the Town Clerk of the Year educational award of $300 presented by the Erie County Town Clerks Association would be applied to this cost.

    15.   Tax Receiver re Termination of L. Fischione & T. Gannon and appointment of Margaret Welker as Clerk PT

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to terminate Laurie Fischione and Teri Gannon as part-time Clerks in the Tax Office effective May 19, 2003 and appoint Margaret Welker as part-time Clerk in the Tax Office effective May 19, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    16.   Recreation Director re Re-appointment of Kathleen Pacella as part-time seasonal Clerk Typist

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint Kathleen Pacella as part-time seasonal Clerk Typist to work in the Burchfield Nature & Art Center effective June 1 - September 16, 2003 at a rate of $7.40 per hour and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    17.   Recreation Director re Appointment of part-time seasonal employees for summer programs

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint the individuals on the attached list as part-time seasonal employees in the Recreation Department effective June 1 - September 16, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    18.   Senior Citizens Supervisor re Purchase of new garbage disposal for Senior Citizens Center

    Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize the purchase of a new garbage disposal for the Senior Citizens Center at a cost of $2095.95.

    PROBLEMS OF THE PUBLIC

    SUGGESTION FOR FLASHING YELLOW LIGHTS NEAR SCHOOLS

    Ed Bucki, 56 Parkside Drive, stated that he had just returned from Dallas and their school districts had flashing yellow lights to enforce the speed limit. He would like to see this incorporated in the Town of West Seneca.

    Chief Gehen stated that many of the signage regulations were stipulated through New York State. He would look into Mr. Bucki's suggestion to see if it was allowable.

    OUTDOOR ICE RINK AT SOCCER FIELD

    Ed Bucki, 56 Parkside Drive, questioned if there were any plans to build an outdoor ice rink in the soccer field.

    Councilman Osmanski stated that they had looked into the possibility of an ice rink in the soccer field, but had not yet come up with a way to make it work.

    WEST SENECA DEVELOPMENTAL CENTER LAND

    Ed Bucki, 56 Parkside Drive, questioned if the Town Board had investigated the possibility of obtaining some of the West Seneca Developmental Center land for green space or recreation.

    Supervisor Clark stated that the Town Board had gone on record stating that the Town of West Seneca wanted the land, but New York State dropped their plans and decided not to sell any of the property.

    PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

    BUDGETARY TRANSFER FOR TECHNOLOGY UPDATES

    Motion by Councilman Graber, seconded by Supervisor Clark, to approve a budgetary transfer of $22,000 from Contingency Account #01.1990.0480 to Account #01.1620.0418 to be used to update some technology involving the town's computer system and Internet access.

    BROAD BAND INTERNET SERVICE

    Motion by Councilman Graber, seconded by Supervisor Clark, to accept the proposal of $21,104 from Dualex Corporation for installing infrastructure necessary to provide Broad Band Internet service to Town Hall and outlying facilities.

    BROAD BAND INTERNET SERVICE    (continued)

    On the question, Councilman Graber advised that one month ago the town's dial-up service provider advised that they would no longer be providing this service to the town. The Utility Advisory Committee had been looking into high-speed Internet access for town facilities, but this information caused them to take quicker action. This project entailed running infrastructure to all the computers throughout the town to Adelphia Business Solutions lines, which would provide Power Link service. The primary reason for this change was to reduce costs, and the net result of the upgrade would be approximately $4000 in lower phone costs per year while doubling the amount of users. The upgrade would also increase speed and improve security. Even though the start-up costs were $21,104 the technology would last for 10 to 15 years into the future. Councilman Graber commented that e-government was in its infancy, but eventually much of government would be conducted over the Internet. He noted the various departments in Town Hall that used the Internet to conduct daily business and access information, so high-speed access was necessary to improve productivity. Councilman Graber thanked Supervisor Clark for his assistance and for designating a technology group consisting of Jim Manley of the Town Clerk's Office and Bldgs. & Grounds Supt. Steve Amoia as a sub-group of the Utility Advisory Committee to work on this project.

    Councilman Osmanski noted that the town had received three proposals for this project. Dualex was not the lowest proposal, but the town had an established relationship with them and they had a larger training and installation component in their proposal. The Town Board also felt it was important to have someone local for support during the changeover to this high-tech equipment.

    RESTRICTED USE PERMIT IN NORTH AMERICA CENTER

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to amend the previous motion of May 5, 2003 concerning Excel Precision Inc. and issue a restricted use permit for D and L Enterprises LLC, Excel Precision Inc., CCT Marketing Inc., David & Laura Lasky, and John and Joan Duggan for Lot 42 and part of Lot 43 located on North America Drive and issue a negative declaration with respect to SEQRA.

    SUPPORT FOR PEOPLE INC. FOR HUD 202 PROGRAM FOR LOW INCOME SENIORS

    Councilman Osmanski read a letter from People Inc. requesting a letter of support from the West Seneca Town Board in their application to the U.S. Department of Housing and Urban Development (HUD) to establish additional apartments for low income seniors through the HUD 202 program.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to support People Inc. in their application to the HUD 202 program for low-income senior housing.

    On the question, Supervisor Clark commented on the demonstrated need in West Seneca and other communities for good, safe, and economical housing for senior citizens. He thought that this type of project was very good and should be encouraged by the town.

    DEBRIS ON ROLLING WOODS LANE

    Councilman Wroblewski questioned the status of a complaint of debris adjacent to 45 Rolling Woods Lane. He asked that Building Inspector Bill Czuprynski address this complaint immediately and also have the grass cut on the center island on Rolling Woods Lane.

    PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

    AGREEMENT WITH W.S. CENTRAL SCHOOL FOR 2003 COPS IN SCHOOLS GRANT

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize the Supervisor to enter into an agreement between the Town of West Seneca and the West Seneca Central School District regarding the 2003 Cops in Schools grant, noting that this agreement provided that the town would apply for the grant and the school district would reimburse the town for the cost of the officers not provided for in the grant.

    On the question, Supervisor Clark stated that this was a good example of how the town and the school district continued to cooperate for the best interest of the students and their safety and well-being. He noted that a pilot program was in place and a police officer was actively and intimately involved with the schools to provide an extra measure of security. Having police presence was a preventative action for the peace of mind and safety of everyone involved in the schools. The officer was primarily based in the senior high schools and worked closely with Chief Gehen. The officer would be available to help out the Police Department in the summer when school was not in session and a number of officers were on vacation. Supervisor Clark thought that this program would be a great partnership with the school system. He thanked Chief Gehen, West Seneca School Superintendent Jim Brotz, and Town Attorney Tim Greenan for their work on this program.

    EXTENSION OF REPAYMENT PERIOD FOR W.S. COMMERCIAL CENTER LLC

    Town Attorney Tim Greenan stated that on January 16, 2003 the West Seneca Town Board entered into an agreement between the town and Erie County under the town's 2000-2001 Community Development Block Grant whereby the town would repay funds to the county for the W.S. Commercial Center LLC project. However, this project was delayed and the town and county agreed to extend the repayment period to begin on December 31, 2004.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the Supervisor to sign the first amendatory agreement regarding the town's 2000-2001 Community Development Block Grant and extend the start of the repayment period for W.S. Commercial Center LLC by one year to December 31, 2004.

    On the question, Supervisor Clark stated that W.S. Commercial Center LLC was a client of an accounting firm that he had a financial interest in, so he would be abstaining from voting on this matter.

    Mr. Greenan did not believe that Supervisor Clark was required to abstain from this motion because it was an agreement between the town and county.
