Supervisor Wallace C. Piotrowski called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Piotrowski read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.

The meeting was dedicated to the memory of Martin Breen Hourihan and Alice Callahan.

4-A   MINUTES TO BE APPROVED

·   Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve Minutes #2010-03 of March 1, 2010.

·   Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve minutes from the March 1, 2010 bid opening for five marked police vehicles.

4-B  COMMUNICATIONS

1.   Supervisor Piotrowski re Attendance of Erik Finbar at appraising seminar

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize Erik Finbar to attend a seminar on appraising at Cornell University, Ithaca, New York, July 12 – 16, 2010 at a cost not to exceed $950.

2.   Supervisor Piotrowski re Attendance of Erik Finbar at exemptions seminar

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize Erik Finbar to attend a seminar on exemptions at the Town of Cheektowaga on May 21, 2010 at a cost not to exceed $95.

On the question, Councilwoman Meegan asked Town Attorney Shawn Martin to schedule a work session for April 5, 2010 at 6:00 P.M. to discuss the Assessor’s Office.

4-B   COMMUNICATIONS

3.   Supervisor Piotrowski re Purchase of laptop computer by Natural Disaster Coordinator

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve the transfer of a laptop computer to Natural Disaster Coordinator Michael Kerl at a cost of $250.

4.   Town Attorney re Appraisal for Burchfield property

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize the Town Attorney to enter into an agreement with Arrow Appraisal in the amount of $2200 authorizing them to conduct an appraisal of the Burchfield property, noting that the appraisal is necessary in order to close out the grant obtained from the NYS Office of Parks and Historic Preservation.

On the question, Councilwoman Meegan asked Town Attorney Shawn Martin to include in the work session notice for April 5, 2010 at 6:00 P.M. a discussion on the Metz House and Burchfield Center.

5.   Town Engineer re Bid date for 2010 Sanitary Sewer Rehabilitation Project

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to set a bid date of April 12, 2010 at 10:00 A.M. for receipt of bids on the 2010 Sanitary Sewer Rehabilitation Project, Job No. S-1003.

6.   Highway Supt. re Purchase requiring Town Board approval

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize payment of $2580 to Neal’s Radiator Service for recoring a radiator.

7.   Chief Gehen re Bid award for five marked police vehicles

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to award the bid for five marked police vehicles to Delacy Ford Inc, 3061 Transit Road, Elma, NY 14059 at their low bid of $79,268.

8.   Chief Gehen re Retirement of Officer Kenton May Jr.

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to accept the retirement of Kenton L. May Jr. and terminate him as Police Officer effective April 18, 2010 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that Officer May served the Town of West Seneca for 33 years.

9.   Chief Gehen re Status change for part-time Public Safety Dispatcher D. Nowicki to seasonal

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to change the status of part-time Public Safety Dispatcher Diane Nowicki to part-time seasonal effective March 1 – 31, 2010 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

 10.   Chief Gehen re Appointment of James Bochenski as part-time Public Safety Dispatcher

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to appoint James J. Bochenski as part-time Public Safety Dispatcher at a rate of $10.95 per hour effective March 16, 2010 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

On the question, Councilwoman Meegan asked Town Attorney Shawn Martin to schedule a work session for April 5, 2010 at 5:30 P.M. to discuss the Police Department expansion.

 11.   Comptroller re 2009 budget transfers

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve the attached list of 2009 budget transfers.

On the question, Councilman Clarke stated that he just received these transfers and would like time to look at them before voting.

Motion by Councilman Clarke, seconded by Councilwoman Meegan, to table this item until the end of the meeting.

 12.   Comptroller re Purchase requiring Town Board approval

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize payment of $3864 to KVS Information Systems Inc. for software subscription service.

 13.   Code Enforcement Officer re Budgetary transfer request

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve a budgetary transfer request of $860 from Acct. #1.3620.0448 to Acct. #1.3620.0444 for the Code Enforcement Office.

 14.   Director of Senior Services re Status change for Carol Kennedy to part-time seasonal

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to change the status of part-time Food Service Worker Carol Kennedy to part-time seasonal effective March 1 – May 28, 2010 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

 15.   Recreation Director re Bid date for arts & crafts supplies

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to set a bid date of April 26, 2010 at 10:00 A.M. for receipt of bids on the furnishing of arts & crafts supplies.

 16.   Highway Supt. re Budgetary transfer request

 

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve a budgetary transfer request as follows for the Highway Department:

$10,000 from Contingent Acct. #1.1990.0480

$5,000 to Acct. #2.5110.0400

$3,000 to Acct. #1.7110.0400

$2,000 to Acct. #1.8160.0400

ISSUES OF THE PUBLIC

AMERICORPS ISSUES

Karen Lucachick questioned if AmeriCorps had paid the $75,000 facility usage fee that was due March 1, 2010.

Comptroller Robert Bielecki responded that AmeriCorps had not yet paid the facility usage fee, but $8000 was paid for February and March.  No other payments were made toward the outstanding balance.

Mrs. Lucachick questioned if an inventory was done at the Burchfield Center before AmeriCorps moved out.

Supervisor Piotrowski responded that an inventory was done and the items that were taken by mistake had been returned.

ISSUES OF THE PUBLIC

STATUS OF SOUND EQUIPMENT FOR COURT ROOM

Amy Carpenter questioned the status of the sound equipment for the court room.

Councilwoman Meegan responded that the town had requested proposals for three plasma screens with LCD projectors and sound equipment and $9000 in funds were available.  She expected to hear something by next week.

TOWN LINK ON ERIE COUNTY INDUSTRIAL DEVELOPMENT SITE

Amy Carpenter referred to her recommendation from August 24, 2009 concerning the link to West Seneca on the Erie County Industrial Development site that was linked to nothing and noted that this had not yet been corrected.

Councilwoman Meegan stated that this will be corrected by IEvolve who will be taking over updates and maintenance of the town’s webpage after the retirement of Jim Manley.

STATUS OF METZ HOUSE AND 20 SCHOOL STREET

Amy Carpenter questioned the status of the Metz House and 20 School Street.

Councilwoman Meegan responded that the Metz House will be discussed at a work session before the April 5, 2010 Town Board meeting.

Code Enforcement Officer Robert Pinnavaia advised that AmeriCorps had obtained a building permit in October 2009 and they were supposed to start the project after their move was complete.

HOUGHTON COLLEGE PROPOSAL

Jim Byrne referred to the proposal for the Houghton College property and stated that 24 years ago a similar proposal was made by a different developer and the demographics have not changed since then.  He commented that the Houghton College property was the best piece of property in West Seneca.  The density of the proposed project was too great and the traffic problems it will create will be enormous.  Mr. Byrne commented on the number of people opposed to the project and the importance of stopping it now and developing the property in accordance with the existing zoning.

ISSUES OF THE PUBLIC

TRANS TEXAS CORRIDOR AND KC SMARTPORT

Francis Lafferty stated that he was watching a television program on the plight of the middle class in the United States and the loss of jobs with over 10 percent unemployment.  He referred to a group that planned to create the trans Texas corridor that will run from the southwest coast of Mexico through to Kansas City and recommended that everyone check out the website www.smartport.com

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

EXECUTIVE SESSION

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to recess to Executive Session at 7:30 P.M. to discuss two litigation matters and a real estate matter.

The Town Board returned from Executive Session at 7:55 P.M.

LEASE WITH GARDENVILLE CAMPUS AT BURCHFIELD

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to enter into a lease with the Gardenville Campus at Burchfield as the sole non-governmental occupant of the building located at 2001 Union Road to provide recreational and educational services not able to be provided directly by the town, with the terms as negotiated by the Town Attorney and the attorney for the organization.

2009 YEAR END BUDGET TRANSFERS

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve the attached list of 2009 budget transfers.
