Supervisor Wallace C. Piotrowski called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Piotrowski read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.

·      Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve Minutes #2011-04 of March 21, 2011.

1.         Supervisor Piotrowski re Retirement of William Falkner as Motor Equipment Operator                                                                    
 
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to accept the retirement of William J Falkner and terminate him as Motor Equipment Operator effective March 26, 2011 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

 2.   Supervisor Piotrowski re Retirement of Gary Schreiner as Motor Equipment Operator
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to accept the retirement of Gary Schreiner and terminate him as Motor Equipment Operator effective March 25, 2011 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

   3.    Supervisor Piotrowski re St John Vianney annual 5K run
        
 
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to grant the request of St. John Vianney Church to hold their 11th annual kickoff run on Thursday, July 21, 2011 at 6:30 P.M. on designated streets in the Town of West Seneca.

   4.   Supervisor Piotrowski re Southtowns Fitness Center 5K run
 
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to grant the request of Southtowns Fitness Center to hold their annual 5K run on Friday, April 29, 2011 beginning at 6:30 P.M. on designated streets in the Town of West Seneca.

   5.   Town Engineer re Bid date for Elmsford Drive & Court Reconstruction Project
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to set a bid date of May 2, 2011 at 10:00 A.M. for receipt of bids on the Elmsford Drive & Court Reconstruction Project, Job No. E-1101.

   6.   Town Engineer re Bid date for Columbia Parkway/Belgia Place Reconstruction Project
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to set a bid date of May 16, 2011 at 10:00 A.M. for receipt of bids on the Columbia Parkway/Belgia Place Reconstruction Project, Job No. C-1002.

  7.   Highway Supt. re Bid award for truck mounted trash loader grapple & dump body
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to award the bid for a truck mounted trash loader grapple and dump body with hoist to Kenworth of Buffalo NY at their bid of $128,533.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize the purchase of one #70528 Jacobsen HR-9016T turbo wide-area rotary mower with cab and cruise control off the state contract #PC64364, Lot III, Item 5, price of $81,803.38.

   9.   Highway Supt. re Purchase of 60-inch side discharge mower
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to authorize the purchase of one Kubota ZD326 zero-turn, 26 hp, 3-cylinder diesel, hydrostatic transmission, 60-inch pro commercial side discharge mower, flat free front tires, delivered, off the state contract #PC62723 price of $11842.

 10.    Highway Supt. re Budgetary transfer request
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve a budgetary transfer request of $6966 from Contingency Acct. #1.1990.0480 to Burchfield Building Acct. #1.7420.0445.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to change the status of part-time Public Safety Dispatchers Diane Nowicki and Greg Lake to part-time seasonal effective April 1 – 30, 2011 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to increase revenue account #1.0001.3021.3333 NYS Aid Court Facility and increase expense account #1.1110.0200.3333 Equipment NYS Grant $28,289.55.

 16.    Highway Supt. re Military leave of absence for Joseph Steen
 
 
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve a military leave of absence for Joseph Steen effective April 8 – 10, 2011 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

ISSUES OF THE PUBLIC
 
          STATUS OF AMERICORPS DEBT
 
         Karen Lucachick, Greenmeadow Drive, questioned the status of the outstanding AmeriCorps debt.
 
         Comptroller Robert Bielecki responded that the last payment was received March 8th.
 
         PROPERTY MAINTENANCE AT FLATTERY’S ON ORCHARD PARK ROAD
 
         Karen Lucachick, Greenmeadow Drive, commented on the appearance of Flattery’s property on Orchard Park Road (old refrigerators and other garbage on site) and suggested that Code Enforcement Officer John Gullo enforce the Property Maintenance Ordinance.
 
         Mr. Gullo responded that he would take care of this tomorrow.
 
         WORK SESSION ON SEWER DISTRICT 13
 
         Karen Lucachick, Greenmeadow Drive, commented on the work session held before the Town Board meeting and was happy to see the power point equipment in use. She also thanked Town Engineer Richard Henry for an informative presentation on Sewer District #13. Mrs. Lucachick questioned if there was a list of old complaints from residents of the sewer district.
 
         Mr. Henry stated that he did not find any previous complaints and the only complaints he had were from the last 45 days.
 
         NOISE COMPLAINT ON MEYER ROAD VOLLEYBALL COURT
 
         Barb Lortz referred to the youth center/volleyball court located on Meyer Road and stated that it is extremely loud in the neighborhood when events are held there. The noise often goes on after 11:00 P.M. and when the neighbors call the police and they respond nothing changes.
 
         Chief Gehen stated that a patrol car responds to all complaints and if the neighbors are not satisfied they can call back and speak with a supervisor. The patrol vehicle will revisit the complaint and if they still do not address the situation an appearance ticket will be issued. Chief Gehen suggested that Ms. Lortz call him tomorrow and he will research past complaints and their disposition.
 
         Amy Carpenter, Woodward Crescent, understood this facility was operating on a temporary basis.
 
         Code Enforcement Officer John Gullo responded that just the outside volleyball court was on a temporary basis and they would have to adhere to allowable noise levels.

ISSUES OF THE PUBLIC
 
         STATUS OF SENECA MALL ASSESSMENT
 
         Amy Carpenter, Woodward Crescent, questioned the status of the Seneca Mall tax assessment.
 
         Town Attorney Shawn Martin advised that it was moved to the end of April.
 
         MAINTENANCE OF FORMER PARK LANE PROPERTY NEAR CAZENOVIA CREEK
 
         Chris Pisanczyn, Union Road, stated that years ago the town removed Park Lane near Cazenovia Creek that was used as an entrance to Houghton College and planted grass. He understood this was removed for safety reasons due to the number of accidents that occurred at that location. Mr. Pisanczyn stated that Houghton College used to maintain the property, but for the last six months it has been neglected and he asked that the town maintain it if it is their responsibility.
 
         ELMSFORD DRIVE RECONSTRUCTION
 
         Tom Beiter, Elmsford Drive, referred to the planned reconstruction of his street and questioned if the work will be done this summer and what provisions will be made for the residents since there is only one entrance to the development.
 
         Town Engineer Richard Henry stated that the bids will be opened in early May and the work should begin in June. The contractor is required to maintain and protect traffic and driveways throughout construction.
 
         Arlene Vogt, Union Road, commented on the flooding that occurs on Elmsford Drive and stated that she knew someone who built a house there in 1962 when the development was new. The houses flooded then and have flooded ever since that time.

         Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to recess to Executive Session at 7:15 P.M. to discuss a real estate matter with Town Attorney Shawn Martin and a personnel matter with Senior Citizens, Recreation & Youth Director Mary Josefiak and Highway Supt. Matthew English.
