Chairman Robert Niederpruem called the meeting to order at 7:00 P.M. followed by the Pledge to the Flag.

Chairman Niederpruem read the Fire Prevention Code instructing the public where to exit in case of a fire or other emergency.

A request from Upstate Cellular Network d/b/a Verizon Wireless, for a special permit and site plan approval for property located at 2801 Seneca Street, being part of Lot No. 198, changing its classification from C-1 to C-1(S), for a 100’ monopole tower and wireless communications antennas, a 12’ x 8’ rooftop equipment shed, together with other site improvements as set forth in the application materials and site plan.
 
Chairman Niederpruem stated that the petitioner was not present at the meeting so the item will be held over until the next meeting.

A request from Delta Sonic for a special permit & site plan approval for property located at 348-350 Langner Road, being part of Lot Nos. 293 & 294, changing its classification from C-2 to C-2(S), for replacement of existing fuel canopy, fuel pumps & underground fuel tanks; demolition of existing convenience store & construction of a new 6488 sf convenience store; construction of a new 4300 sf detail shop; and construction of a new 1750 sf oil change center.

Attorney James Boglioli represented Delta Sonic and stated that this project was previously before the Planning Board. They were proposing to demolish the convenience store, fuel pumps and canopy and construct a new 6488 sf convenience store along with a new 4300 sf detail shop and a new 1750 sf oil change center which will form one complex of buildings at the rear of the site. There will also be eight new gas pumps with canopy. The project is in the NYS Brownfields Program and an environmental cleanup will be done this winter. The tanks will be removed along with contaminated soil and the site will be clean for construction in spring. The existing car wash will be maintained and traffic circulation on site will be improved. There will be a dedicated exit from the car wash in each direction onto Langner Road. Circulation around the gas pumps will also be improved and there will be 30 parking spaces. Mr. Boglioli indicated the location of the dumpster and commented on the proposed landscaping and appearance of the proposed building.
 
Mr. Nigro questioned if there will be a restaurant in the new building.
 
Mike Green, Vice President of construction for Delta Sonic, advised they were proposing a Tim Hortons, Brick Oven, and a sub shop and there will be a waiting area for customers having their vehicles detailed or an oil change. The plans submitted were the corporate model and the proposed building will be very similar to that.
 
Mr. Mendola commented on the traffic pattern onsite and thought it was a better pattern than previously presented. He further suggested an additional hydrant at the rear of the building.
 
Chairman Niederpruem referred to the distance between the fire hydrant indicated on the plan and the remote back corner of the building. He suggested extending the 6-inch watermain to the back and placing another fire hydrant in the back quadrant.
 
Mr. Rathmann questioned if the storm drainage was going to the wetlands area.

Mr. Green responded that this was approved the last time the project was submitted.
 
Mr. Mendola commented on the changes in the Engineering Department since the previous project was submitted.
 
Mr. Green responded that the plans were being reviewed by the Engineering Department, but the design does comply with DEC requirements so they do not anticipate any problems.
 
Mr. Rathmann questioned if the sidewalk in front of the building was an elevated curb or flush sidewalk.
 
Mr. Green stated that the sidewalk will be flush to avoid falls and there will be decorative pipe bollards to stop vehicles from driving into the front of the building.
 
Mr. Mendola questioned the sanitary sewer.
 
Mr. Green stated the sanitary sewer runs through the easement.
 
Chairman Niederpruem questioned who oversees the demolition and if the sewer lateral is terminated.
 
Code Enforcement Officer John Gullo advised that his department is responsible for overseeing the demolition and the sewer lateral is terminated so there is no water infiltration. They will also have to get statements from the DEC concerning the tank and soil removal and an asbestos abatement.
 
Mr. Mendola questioned if the facility will be open during the demolition.
 
Mr. Green responded that they will try to keep the car wash open. They were looking to begin cleanup of the site by mid January, so the gas pumps will be gone and the store will be closed.
 
Mr. Mendola was concerned that some of the stacking area for the car wash will be eliminated while construction is taking place.
 
Mr. Green stated they have found in the past when reconstruction is started the business is reduced to minimal at that site; however, he offered to prepare a plan to address operation of the site during the construction period.

Mr. Mendola suggested sufficient signage to address the temporary condition and keep the situation safe.
 
No comments were received from the public.
 
          Chairman Niederpruem noted that the project was submitted for SEQR review and no negative comments were received. He further noted that this was a two phase application with the special use permit and site plan.
 
          Motion by Mendola, seconded by Rathmann, to issue a negative declaration with regard to SEQR for the project at 348-350 Langner Road, noting that no negative comments were received from the involved agencies.

          Motion by Rathmann, seconded by Mendola, to recommend approval of the request for a special permit for property located at 348-350 Langner Road, being part of Lot Nos. 293 & 294, changing its classification from C-2 to C-2(S), for replacement of existing fuel canopy, fuel pumps & underground fuel tanks; demolition of existing convenience store & construction of a new 6488 sf convenience store; construction of a new 4300 sf detail shop; and construction of a new 1750 sf oil change center.
