Supervisor Sheila M. Meegan called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Meegan read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.
 
The meeting was dedicated to the memory of Linda Truslow, Marie Jarnot, Ruth Jordan, Pam Gunning, Thomas Quinn Jr., Nate Benderson and John Dasta.

Town Attorney Shawn Martin stated he will be talking with Town of Elma Supervisor Dennis Powers this week to clarify changes prior to presenting this agreement to the Town Board for approval at next month’s meeting.

Motion by Supervisor Meegan, seconded by Councilman Hart, to suspend the rules to allow baseball representative Kevin Chodkowski to speak on the use of Firemen’s Park for possible fundraising purposes and possible future opportunities for Firemen’s Park and boy’s baseball.

Kevin Chodkowski, President of West Seneca Baseball, stated he would like to see the baseball program condensed into one facility. The projected plan involved the addition of four ball diamonds at Firemen’s Park - three 60’ – 70’ combination diamonds and a featured 90’ diamond. Also included in the design is a concession stand with bathrooms, a new monument honoring the volunteer firemen and a walking path. The diamonds will eventually be enclosed with fences and lights and parking will be increased to accommodate the additional fields.
 
Councilman Hart questioned how the project will be funded.
 
Mr. Chodkowski responded that money will be acquired through fundraising and corporate sponsors. The projected cost is $500,000 and they anticipate raising this over a two or three year period.
 
Town Engineer Steven Tanner stated that over the past 8 to 10 months the Engineering Department has surveyed the fields for existing conditions, property boundaries and topographic surveys. Overlays were designed using auto cad to project how many baseball fields will fit. They also looked into buying land from the adjoining parcel, but he did not believe that was possible. The Engineering Department prepared a draft grading plan that can be utilized for a “bid ready” drawing if the town decides to move forward.
 
Highway Sup’t. Matthew English stated that he has met with various departments and believes this is a good plan. The project will involve a lot of work but will be good for the town.
 
Town Attorney Shawn Martin commented on the importance of providing the public with information on the project and fundraising events by utilizing web sites and social media. He suggested a motion be made reflecting the Town Board’s seal of approval supporting the plan as indicated, depending on land acquisitions, but reflecting the willingness of the Town Board to support the project as a concept.
 
Supervisor Meegan commented that fundraising will be able to take place at Firemen’s Park if the event does not include a beer tent.
 
Councilman Hart questioned who will maintain the diamonds once developed and Mr. English stated that the diamonds will be maintained in the same fashion as Sunshine Park’s diamonds utilizing both full and part-time town staff.

Motion by Councilman Hart, seconded by Councilman Rusinski, to approve the concept based on future plans to allow the Youth Baseball Association to go forward with fundraising, and in the future based on Town Board approval, construction of ball diamonds.

1.      Supervisor Meegan re Southtowns Fitness 4th annual SFC Race for a Cause                              
 
 
Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve the request of Southtowns Fitness Center to hold their 4th annual SFC Race for a Cause on Friday, April 27, 2012 beginning at 6:30 P.M.

 
            On the question, Councilman Hart questioned what the cause was and whether or not the town provides any security for this event.
 
Chief Gehen responded that his department has provided officers to block off intersections for this event for the past four years. The cause differs each year, the event has been well planned, and there has never been a problem.

2.    Supervisor Meegan re Creation of Recreation Leader position
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to create the position of Recreation Leader (Competitive) and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

 
On the question, Councilman Hart questioned the salary for this position.
 
Supervisor Meegan stated that a salary has yet to be established. The title has to first be brought into the town’s inventory and then discussions will take place with the department head, union representatives and Erie County. After interviews are conducted a provisional appointment will be made. Supervisor Meegan further commented that when the consolidation of senior services, recreation and youth took place it was an opportunity for Mary Josefiak, Director of Senior Services, Recreation and Youth, to enhance services along with eliminating services that were no longer working, always keeping in mind that she would need additional help in the future.

Mrs. Josefiak commented on the need for additional staffing in her department. Prior to the combining of senior services with recreation, the Recreation Department was combined with the Youth Bureau. Some positions have been eliminated, however her current staff is accounted for and she cannot do it alone. Having an assistant will allow programs to expand and move forward. There are approximately 75 programs that are considered special events such as dances, tournaments, sign-ups at recreation, parties & scheduling of sporting events for the ice rink and ball diamonds.
 
Councilman Rusinski stated that he is not comfortable creating a new position at this time based on the information he currently has. He will be meeting with Mrs. Josefiak next Monday to become better informed on this issue.

   6.    Town Engineer re Bid date for Dover & Greenmeadow Reconstruction Project
 
 
Motion by Supervisor Meegan, seconded by Councilman Rusinski, to set a bid date of May 16, 2012 at 10:00 A.M. for receipt of bids on the Dover/Greenmeadow Drive Reconstruction Project, noting that funding is based on the bonding that was approved at the March 12, 2012 Town Board Meeting.

   7.    Town Engineer re Change Order for Occhino Paving for French Road reconstruction project
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to approve a change order not to exceed $8550 for Occhino Paving Corporation for additional work related to the reconstruction of French Road, noting that funding is available under budget line #5.5500.8197.0503.

 
On the question, Councilman Rusinski questioned the amount of change orders submitted by Occhino Paving Corporation relative to this project.
 
Town Engineer Steven Tanner stated that he has reviewed the change orders that reflect items the town has requested to be done and items that were unforeseen and discovered during the road reconstruction project. 
 
Highway Supt. Matthew English stated that this particular change order reflects replacement and installation of a town owned fence in the right-of-way that was removed during the reconstruction of French Road and was initially not included in the project cost.

8.   Town Engineer re Purchase of sewer camera & accessories
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the purchase of a new sewer camera and associated accessories in the amount of $42,655 from Pierce Equipment Company, noting they are the sole distributor in our area of Cues equipment and funding is appropriated in the 2012 budget line #03.8100.1207.
 
On the question, Councilman Rusinski noted this is a replacement camera.

9.   Town Engineer re Purchase requiring Town Board approval
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize payment of $13,220 to Joe Johnson Equipment for repair of the pump that operates the hose reel on truck TR-550, noting that funding is available under budget line #03.8100.0443 – Equipment Vehicle Maintenance.

10. Highway Sup’t. re NYSDOT utility work agreement
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to approve an agreement between the Town of West Seneca and New York State Department of Transportation (NYSDOT) regarding utility work on state highways and authorize the Supervisor to sign the necessary forms, noting the agreement allows the town to be reimbursed by the NYSDOT for costs associated with removal and relocation of a light pole at Seneca Street and Wildwood Avenue.

 
On the question, Councilman Hart questioned what this involved.
 
Highway Sup’t. Matthew English stated that the NYSDOT was removing a pole and costs associated with the removal are paid up front by the town and reimbursed by the state at a later date.

Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize Highway Sup’t. Matthew English and Deputy Highway Sup’t. Alan Kerner to attend the 2012 School for Highway Superintendents June 11 – 13, 2012 in Ithaca, NY at a total cost not to exceed $1,500.

Motion by Supervisor Meegan, seconded by Councilman Hart, to terminate Buildings & Grounds laborers Eric Doering, John Kaminski and Alex Olszewski effective April 9, 2012 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

 
On the question, Councilman Rusinski questioned why these employees were being terminated and Highway Sup’t. Matthew English stated that the terminations were requested by the individuals.

18. Chief Gehen re Retirement of Dennis Bloom
 
 
Motion by Supervisor Meegan, seconded by Councilman Hart, to accept the retirement of Dennis Bloom and terminate him as Detective effective April 15, 2012 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that Detective Bloom has served the town for 31 years.

Chief Gehen responded that this position has already been filled and a vacancy now exists for an ID Officer. The ID Officer position which is open to all patrolmen has been posted and will be filled based on seniority.
 
          Councilman Rusinski thanked Detective Bloom for his years of service to the town and Supervisor Meegan further commented on Detective Bloom’s dedication to the youth of our town and wished him well.

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the proposal from Paragon Forming & Design, 889 Erie Avenue, North Tonawanda, NY 14120 for improvements to the Town Clerk’s office at their low proposal amount of $10,690.00, noting that funding is appropriated in the Town Clerk’s budget.

 
          On the question, Councilman Hart commented that Paragon’s proposal was the low quote received for security and other improvements in the Town Clerk’s office.

Motion by Supervisor Meegan seconded by Councilman Hart, to terminate Donald Schultz as Highway Heavy Equipment Operator and appoint Donald Schultz as Highway Working Crew Chief, Group 6, Step 5, at a rate of $27.77/HR. effective April 16, 2012 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.
 

          On the question, Councilman Rusinski questioned why this appointment was taking place and Highway Sup’t. Matthew English responded that this appointment was due to the retirement of a previous employee.

Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize the purchase of materials and services from Expert Fence Company to take down and replace two backstops at Firemen’s Park at their low quote of $15,900.00, noting that funding is available in the various recreation projects within the town fund.

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to authorize the purchase of materials and services from Iroquois Fence Company to take down & replace the existing 6’ fence around Veteran’s Park pool at their low quote of $14,740.00, noting that funding is available in the various recreation projects within the town fund.

Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize the purchase of materials and services from Expert Fence Company to take down & replace the existing 4’ fence around Veteran’s Park 90’ baseball diamond at their low quote of $16,300.00, noting that funding is available in the various recreation projects within the town fund.

Motion by Supervisor Meegan, seconded by Councilman Hart, to award the bid for emergency repair at Centennial Park baseball field dugouts to Pirritano Excavating, Inc. at their low quote of $20,000.

On the question, Councilman Rusinski questioned if it was necessary to identify where funding is coming from and Highway Sup’t. Matthew English stated there is a specific line for this item.

STATUS OF SECURITY CAMERAS
 
          Beverly Leising, questioned if the security cameras had been purchased and installed.
 
Supervisor Meegan advised that the Assembly had not yet approved the reappropriation of funds. 
 
SEWER PUBLIC HEARING AND BONDING
 
Beverly Leising questioned why the public hearing on March 26th regarding sewer improvements was scheduled for 5:00 P.M. She felt it would have been more effective if it were scheduled at a later time.

Supervisor Meegan stated that the meeting was held at 5:00 P.M. because it was a scheduled work session and it was published for weeks in advance.
 
Mrs. Leising complimented Town Clerk Jacqueline Felser on her efforts in publishing the meeting. She further questioned if an approval is necessary for a bond issue or if a public meeting fulfills the requirement.
 
Town Attorney Shawn Martin responded that as the project is currently written it only requires Town Board approval. There is no overlay district or any district being merged or created; and therefore, it is not subject to a mandatory referendum. There are a number of different ways to schedule a project and if the intention is to create an overlay district or merge existing districts it would be subject to a referendum. Simply making an improvement within an existing district does not require a referendum.
 
Mrs. Leising suggested that clarification of this be posted on the website. She further questioned who will be operating the cameras that will be used in the sewers.
 
Town Engineer Steven Tanner responded that town employees will operate the cameras and they are qualified to do so.
 
STATUS OF RFP FOR AMBULANCE SERVICE
 
Beverly Leising questioned the status of the request for proposals for an ambulance service.
 
Supervisor Meegan responded that the request for proposals had just been sent out and they had not yet received any back. All proposals will be made public when returned.
 
BULLIS ROAD REPAIRS
 
Charlene Poole spoke on the deplorable condition of Bullis Road.
 
Highway Supt. Matthew English responded that Bullis Road was on the list to be chipped and sealed. He had received one quote and was awaiting another. Both ends of Bullis Road will be done.
 
METRO BUSES TURNING ON RED LIGHTS
 
Charlene Poole asked the police to watch for metro buses making a right on red without stopping at Lein Road and also at Seneca Street and Union Road.

GARBAGE TOTES
Linda Toy suggested the town provide garbage totes to residents and thought it would assist with rat problems.
Councilman Rusinski stated that he will be speaking with Highway Sup’t. Matthew English regarding putting out a request for proposals for the purchase of totes that work for the town.
Motion by Councilman Rusinski, seconded by Councilman Hart, to request proposals for garbage totes for town residents.

POLICE DEPARTMENT GRANT
Amy Carpenter questioned the status of the Police Department grant.
Supervisor Meegan stated they had discussed with Grantwriter Connie Miner redesignating the ice rink funds ($250,000) for the police department expansion and were awaiting approval.
Mrs. Carpenter questioned if it was ever determined what happened to the original grant and Supervisor Meegan advised that it was made public that Senator Stachowski had pulled the grant prior to leaving office.
Councilman Hart stated that he talked to Senator Stachowski and he was not aware that the grant had been pulled.
HIGHWAY SAVINGS
Amy Carpenter questioned the savings in the Highway Department from the mild winter.
Highway Supt. Matthew English responded that he orders 8000 ton of salt each year and they have to buy 70 percent of that. He estimated $120,000 savings on salt but did not have any figures on the overtime saved.
MEETING WITH SCHOOL DISTRICT
Amy Carpenter questioned if a date has been scheduled to meet with the School District.
Supervisor Meegan stated that a meeting will take place with Dr. Crawford sometime in the next couple weeks to discuss the peer counseling program.

LIFEGUARD INSRUCTOR TRAINING CLASS
Amy Carpenter referred to the attendance of Matt Melski at the lifeguard instructor training class and questioned if it will be offered to residents and the cost.
Director of Senior Services, Recreation and Youth Mary Josefiak responded that the class will be advertised on the website and newspaper and there will be a cost to attend.
FINANCIAL ADVISOR
Karen Lucachik questioned who did the work of a financial advisor (bonding, etc.) prior to contracting with Capital Markets.
Town Attorney Shawn Martin advised that Capital Markets has been the financial advisor. The town recently requested proposals from firms to ensure they were receiving the best price and Capital Markets was the lowest quote.
APPOINTMENTS TO PLANNING & ZONING BOARD
Karen Lucachik commented on the reappointment of Donald Mendola to the Planning Board and stated that he does a very good job, but there are people that are reappointed that should not be. She felt it was important to hire new people.
STATUS OF AMERICORPS PAYMENTS
Karen Lucachik questioned the status of AmeriCorps payments and if anything was received from the sale of the house on School Street.
Patrick Clancy of the Finance Department advised that the May payment was received.
Town Attorney Shawn Martin stated they were meeting with AmeriCorps tomorrow.
SENECA POINTE PROPERTY TAXES
Karen Lucachik questioned why Seneca Pointe, a senior housing facility on Orchard Park Road, does not pay taxes and Supervisor Meegan stated she would look into it.
CLARIFICATION ON FENCE PROPOSALS
George Clifford questioned the fence proposals that were on the agenda and Highway Sup’t. Matthew English responded that the town does not have the manpower or supplies to do the work that is required.

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS
PRESCRIPTION DRUG DROPOFF
Chief Gehen announced there will be a prescription drug dropoff station held on Saturday, April 28th from 10:00 A.M. until 2:00 P.M. at the West Seneca Senior Citizens Center. The last two held turned in over 1300 lbs of old prescription medications.
          GUIDELINES FOR GRASS PICKUP
Highway Supt. Matthew English stated that grass clippings should be placed in returnable containers, not plastic bags. He further noted that the transfer station is open to the public for free mulch and compost Monday – Friday, 7:30 A.M. – 2:30 P.M.
