16.   Town Engineer re Race Street Reconstruction, change order #1

Motion by Councilman Osmanski, seconded by Councilman Hicks, to approve Change Order No. 1 in the amount of $15,253.59 for Visone Construction Inc., 79 Sheldon Avenue, Depew, NY 14043, for various extras on the Race Street Reconstruction Project, Job No. R-0002, bringing the total contract amount to $298,014.14.

Supervisor Clark noted that Visone Construction was a client of an accounting firm that he had a financial interest in.

Motion by Supervisor Clark, seconded by Councilman Osmanski, to accept the Sunset Creek Court Subdivision, Phase I, Sublot Nos. 1 - 27, 54, 55, and 79 - 93, completed by Cimato Brothers Construction Inc., 9220 Transit Road, East Amherst, NY 14226, under Public Improvement Permit No. 00-03.

18.   Town Engineer re Status change for Robert Klavoon & Maureen Terhart to part-time seasonal

Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize Highway Supt. Pat Finnegan and Deputy Highway Supt. Edward Kowalewski to attend the Association of Towns 2001 Highway School in Ithaca, New York, June 4 - 6, 2001 at a total cost not to exceed $800.

33.   Town Clerk re Attendance at NYALGRO conference

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize Town Clerk Patricia Wisniewski to attend the annual NYALGRO conference in Alexandria Bay, New York, June 10 - 13, 2001 at a cost not to exceed $550.

34.   Town Clerk re Southgate Plaza amusement license

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to grant an amusement license to Southgate Plaza Merchants Association for a carnival to be held on their grounds May 25 - 27, 2001.

35.   Assessor re Lease agreement for copier

Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize the Supervisor to sign a 42-month lease agreement with Duplicating Consultants in the amount of $115 per month for an AR 155 copier, noting that the lease agreement includes service, parts and supplies.

Councilman Hicks stated that he was abstaining from voting on this motion because he was employed by Duplicating Consultants, and they had been doing business with the town prior to his election.

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint the individuals on the attached list as part-time seasonal employees effective June 1 - September 16, 2001 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

    REAPPOINTMENT OF JAMES RATHMANN TO PLANNING BOARD

    Motion by Councilman Graber, seconded by Supervisor Clark, to reappoint James Rathmann to the West Seneca Planning Board for a seven year term effective June 4, 2000 through June 3, 2007 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    On the question, Supervisor Clark commented that Mr. Rathmann was a certified landscape architect and performed his duties admirably.

    Councilman Osmanski further noted that Mr. Rathmann was the main designer of Burchfield Park.

    APPOINTMENT OF DENISE ACKERMAN AS PART-TIME CLERK TYPIST

    Motion by Councilman Graber, seconded by Councilman Wroblewski, to appoint Denise M. Ackerman as part-time Clerk Typist effective May 15, 2001 at a rate of $9 per hour and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that this was a provisional appointment pending successful completion of the interview process with the Town Justices.

    PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

    GRANT AWARD FOR ENERGY MANAGEMENT PROGRAM

    Councilman Graber stated that he had received notification from the New York State Energy Research and Development Authority that the town was awarded $50,000 towards the administration of the Energy Management Program that was currently in progress. The town was working in collaboration with Siemens Building Technologies and they were looking for further grants that would help achieve the goal of reducing the cost of energy.

    APPOINTMENT OF RAYMOND BALL TO LIBRARY BOARD

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint Raymond B. Ball as a Trustee to the West Seneca Library Board effective May 15 - December 31, 2001, noting that Mr. Ball would be replacing William Daetsch who resigned from the board.

    On the question, Councilman Graber stated that he had known Mr. Ball for many years and he always showed a keen interest in community activities. He was not afraid to give his opinion, both positive and negative. Councilman Graber thought the town was fortunate to have an individual of Mr. Ball's caliber serve as Trustee for the Library Board.

    Supervisor Clark thanked Bill Daetsch for his many years of service on the Library Board, even after he had moved out of West Seneca.

    STATUS REPORT ON TONY ROME'S DRAINAGE

    Councilman Osmanski questioned the status of the drainage situation at Tony Rome's.

    Building Inspector Bill Czuprynski responded that summonses were issued and they were in court last Friday for their first appearance. The drainage survey was completed and approved by the Engineering Department and was hand delivered to Tony Rome's. It was now up to Tony Rome's to hire a contractor to do the work, but the deadline was postponed for two weeks because the owner was in Florida.

    HANDICAPPED DOORS AT WEST SENECA LIBRARY

    Councilman Hicks stated that for the past year Councilman Graber had been trying to secure Community Block Grant funds for the West Seneca Library for installation of handicapped access doors. As liaison to the Library Committee, Councilman Hicks met with Legislator John Greenan and they were able to secure funds through a different means of creative financing. The handicapped doors should be installed by June 1st.

    PURCHASE OF TRACTOR FOR BUILDINGS & GROUNDS DEPARTMENT

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize the purchase of a New Holland Model TC29 (4wd) tractor for use in the Buildings & Grounds Department, off the current New York State Contract at a cost of $17,133.

    PUBLIC HEARING SCHEDULED FOR NO PARKING ON ORCHARD PARK ROAD

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to schedule a public hearing for Monday, June 11, 2001 at 7:30 P.M. to consider an amendment to the Traffic Ordinance with regard to no parking on both sides of Orchard Park Road from Marilyn Drive to Allendale Road.
